Refund & Cancellation Policy

At Eveningstar Productions, we are committed to delivering exceptional quality on every project. This policy outlines the terms under which refunds and cancellations are handled for our video production and creative services.
Because our work is highly customised, creative, and involves significant time, skilled labour, and resources from the outset, our refund policy reflects the nature of bespoke professional services.
Please note: Eveningstar Productions is a professional services company. We do not sell physical products. This policy governs services rendered — including video production, film direction, editing, and related creative services.
1. Advance / Retainer Payments
All confirmed projects require a non-refundable advance payment (typically 50% of the agreed project fee) before production commences. This advance covers:
- Creative development, scripting, and pre-production planning
- Equipment booking and crew scheduling
- Location scouting and logistics
- Administrative and operational costs
This advance is non-refundable under any circumstances once production has been confirmed and commenced.
2. Cancellation by the Client
If a Client wishes to cancel a confirmed project, the following terms apply based on the stage of production:
- Before pre-production begins: Advance paid is non-refundable. No further charges apply.
- During pre-production: Advance is non-refundable. Client is liable for any third-party costs already incurred (equipment bookings, crew, locations, etc.).
- During production (shoot phase): Client is liable for the full cost of all shoot days completed, all third-party bookings, and a kill fee of up to 25% of the remaining project value.
- During post-production: Client is liable for all work completed to date (billed at a pro-rated rate) plus all third-party costs. Partial deliverables will be provided for work completed.
All cancellation requests must be submitted in writing to kaush4@gmail.com. Cancellation takes effect from the date the written notice is received and acknowledged by us.
3. Project Delays by Client
If a project is delayed by more than 30 days due to the Client's failure to provide required materials, approvals, or feedback, Eveningstar Productions reserves the right to:
- Invoice for work completed to date
- Treat the project as cancelled and apply the cancellation terms above
- Reschedule the project subject to crew and equipment availability, which may result in revised fees
4. Dissatisfaction with Deliverables
We are committed to your satisfaction. If you are not satisfied with a deliverable:
- You are entitled to revisions as specified in your project agreement.
- Concerns must be communicated in writing within 7 days of delivery of the relevant deliverable.
- We will work diligently to address reasonable concerns within the agreed scope.
- Subjective creative differences that fall within the agreed brief do not constitute grounds for a refund.
Refunds are not issued on the basis of subjective creative preference if the deliverable meets the agreed technical and creative brief.
5. Exceptional Circumstances — Refund at Discretion
In exceptional circumstances (such as Eveningstar Productions being unable to complete a project due to unforeseen events on our end), we will:
- Refund any portion of the advance attributable to work not yet commenced
- Deliver all work completed to date in an appropriate format
- Provide reasonable notice and collaborate on project transition where possible

Please include your name, project reference, the nature of your concern, and any relevant documentation. We aim to respond to all refund enquiries within 5 business days.
7. Governing Law
This policy is governed by the laws of India. Any disputes arising from this policy shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
